EPY Host Terms of Service (TOS)

Introduction

These terms and conditions are applicable to all services provided by www.epyhost.com and its affiliated entities. EPY Host, also referred to herein as the "Company," is a legally registered corporate entity. These terms govern all clients (referred to as "Subscribers") associated with this Company, regardless of whether they are paid subscribers or recipients of services from EPY Host or its affiliated entities. By using our services, you explicitly agree to the following terms:

1. Age Restrictions for Clients

1.1 Age Requirement: Any client placing orders through our online system at EPY Host must confirm and guarantee that they are at least 18 years old and possess the legal capacity to enter into this agreement.

1.2 Age Restrictions: If the client is below 18 years of age, they are required to promptly inform us and terminate their services. They will be prohibited from using any other services provided by this Company.

1.3 Clients Under 18: Clients under the age of 18 must obtain explicit consent from their parents or legal guardians to access this site and engage in any of our services. We disclaim all liabilities and responsibilities concerning difficulties or legal issues relating to a client's age misrepresentation.

2. Access, Limitations, and Restrictions

2.1 Access Requirements: Before gaining access to EPY Host's control panels, you will be required to provide personal information, which we safeguard in our records. The customer must ensure all information is complete, accurate, and truthful. We reserve the right to refuse access to our services if we find any errors, omissions, or falsifications in the data provided. We also retain the authority to terminate or suspend your access at any time without a refund if fraudulent activity is suspected.

2.2 Limited Usage License: Subject to these Terms and Conditions, we grant you a limited, non-exclusive, non-transferable personal license to access and utilize our services. Our services are exclusively for private and authorized commercial purposes; all unlawful uses are strictly prohibited. You are obligated to prevent any unauthorized intrusion or misuse of our services. We reserve the right to impose bandwidth limits and enforce network security measures. Unauthorized utilization of our services will result in immediate termination of this limited license, and violators may be subject to legal prosecution to the fullest extent permitted by applicable law.

3. Know Your Customer (KYC) & Identity Verification

To maintain a secure, compliant, and trustworthy infrastructure, EPY Host enforces a mandatory KYC policy.

3.1 Required Information: Customers must provide accurate and original details, including Full Name, Email Address, Phone Number, Address, Country, and Postal Code.

3.2 General Policies: If fake or inaccurate information is detected, you will be given one opportunity to correct and resubmit your details using a valid government-issued ID and biometric verification. We welcome customers globally; however, orders placed via VPNs, Proxies, or Tor networks will be automatically flagged and rejected.

3.3 Refund Policy on KYC Failure: If you are unable to provide the required valid KYC details, refunds will strictly be issued ONLY for payments made via Visa, Mastercard, and American Express (Amex). Payments made through Cryptocurrency, alternative gateways, or any other non-reversible methods are strictly non-refundable in the event of a KYC failure. If KYC fields are intentionally left empty or fake information is submitted, your account will be permanently banned. Any funds associated with a banned account will be frozen, and no refund will be issued under any circumstances.

3.4 Privacy: Your personal information will never be sold, leaked, or shared with any unauthorized third party. EPY Host is fully committed to keeping your data secure and confidential.

4. Billing, Payments, Refunds, and Subscriptions

4.1 Billing Process: EPY Host will initiate the setup of your chosen services only upon receiving full payment. You will receive an invoice at least 14 days before the due date. It is your responsibility to ensure prompt payment.

4.2 Payment Options: Should your account have an outstanding balance for over 24 hours, EPY Host reserves the right to suspend or terminate your services until complete payment is made. We accept Credit Cards, Crypto (Bitcoin/USDT), Wire Transfers, and other verified methods.

4.3 Refund Policy: EPY Host does NOT issue refunds, except in cases covered by our Service Level Agreement (Section 11) or in the event of a proven billing discrepancy.

4.4 Automated Subscriptions: When utilizing Credit Card payments, you are responsible for the automated subscription that activates upon purchase. Funds will be automatically deducted on each due date. We do not provide refunds for automated subscription renewals. To cancel, you must manage the cancellation via your client portal or submit a ticket prior to the renewal date.

4.5 Set-Up Fees: For dedicated server rentals, standard set-up fees are waived unless necessitated by custom third-party requirements.

5. Cryptocurrency Anti-Money Laundering (AML) and Compliance Policy

By using cryptocurrency payments, including but not limited to Bitcoin (BTC), Tether (USDT), Ethereum (ETH), Litecoin (LTC), or any other supported digital asset, for services provided by EPY Host, you acknowledge and agree to the following Anti-Money Laundering (AML) and compliance requirements. These terms apply to all customers, orders, and transactions without exception.

5.1 Prohibited and High-Risk Transactions

To maintain strict regulatory compliance and protect our infrastructure, EPY Host utilizes advanced blockchain analytics and AML monitoring systems to screen all incoming cryptocurrency transactions in real time.

We strictly prohibit payments connected to, originating from, or linked with any of the following categories:

• Child exploitation, abuse-related services, terrorist financing, or drug trafficking operations.
• Darknet marketplaces, illegal online services, or criminal organizations.
• Cryptocurrency mixers, tumblers, obfuscation services, or privacy-enhancing laundering tools designed to conceal transaction origins.
• Stolen cryptocurrency, fraudulent schemes, phishing operations, ransomware, extortion, or scam-related funds.
• Wallets, entities, or exchanges subject to international sanctions, law enforcement investigations, or judicial enforcement actions.
• Fraudulent, hacked, or compromised cryptocurrency exchanges, including exchanges involved in exit scams or illegal financial conduct.
• Unlicensed or illegal gambling platforms and related activities.
• Any organization or individual associated with terrorism financing, cybercrime, or critical security threats.
• Cryptocurrency ATM operators or cash-based crypto services deemed unregulated or insufficiently compliant with KYC and AML standards.

5.2 Enforcement Actions and Account Termination

If a cryptocurrency payment is flagged by our AML monitoring systems as suspicious, prohibited, or high-risk, EPY Host reserves the right to take immediate enforcement action without prior notice.

Such actions may include:

• Immediate freezing and isolation of flagged digital assets.
• Permanent rejection of the transaction.
• Strict no-refund enforcement for blacklisted or suspicious funds.
• Suspension or permanent termination of all active hosting services, servers, and customer accounts.
• Cancellation of pending or unpaid orders associated with the flagged transaction.
• Cooperation with law enforcement agencies, financial institutions, or regulatory authorities where legally required.

5.3 Customer Responsibility

Customers are solely responsible for ensuring that all cryptocurrency funds sent to EPY Host originate from lawful and verifiable sources. By transmitting cryptocurrency to our payment addresses, you confirm that you fully accept responsibility for the legitimacy and origin of your funds.

6. Services Offered

6.1 Dedicated & Bare Metal Servers: EPY Host provides high-performance server solutions with varying processing power, RAM, and storage specifications.

6.2 Colocation Services: Comprehensive colocation encompassing power supply, cabinet space, uplink connections, and IP allocations.

6.3 DDoS Mitigation: We provide robust Level 3 ingress traffic filtering to protect against Layer 1 to 6 DDoS attacks.

6.4 IP Transit Services: Diverse global IP transit connectivity options for colocation subscribers.

7. Copyright and Intellectual Property rights

All materials accessible through our network constitute our proprietary information. We do not tolerate copyright infringement. You may not copy, distribute, modify, or transmit our website content without prior written consent. You do not acquire any ownership or intellectual property rights through the use of our services.

8. Unacceptable Content and Activities

To ensure the security, stability, and integrity of our global network, we enforce a strict Acceptable Use Policy (AUP). The use of our services to host, store, transmit, or promote any of the following content or activities is strictly prohibited:

Network Abuse and Cybercrime

• IP Spoofing & Header Forgery: Forging of IP addresses, network packet headers, or email headers to conceal the origin of traffic.
• Denial of Service (DDoS/DoS): Initiating, participating in, or facilitating any Distributed Denial of Service (DDoS) attacks or network flooding.
• Malware & Command/Control (C2): Hosting, distributing, or executing malicious software, including viruses, trojans, ransomware, or operating Command and Control (C2) servers.
• Network Probing & Scanning: Unauthorized port scanning, vulnerability probing, or brute-force attacks against our network or any third-party infrastructure.
• Phishing & Credential Harvesting: Hosting fraudulent websites, fake login pages (e.g., cPanel, webmail, banking), or engaging in identity theft operations.

Illegal and Harmful Content

• Child Sexual Abuse Material (CSAM): Zero-tolerance for the hosting, distribution, or promotion of child exploitation material. Such accounts will be immediately terminated and reported to relevant law enforcement agencies.
• Terrorism & Extremism: Content that promotes, encourages, or provides instructions for acts of terrorism, violence, or the creation of weapons.
• Human Trafficking: Any material or service that facilitates or promotes human trafficking or illegal prostitution.
• Illegal Substances: The sale, distribution, or promotion of illegal drugs, prescription medications without a license, or related contraband.

Fraud and Financial Crimes

• Carding & Stolen Data: The sale, distribution, or storage of stolen credit card information, leaked databases, or compromised personal identity data.
• Ponzi Schemes & HYIPs: Hosting High-Yield Investment Programs (HYIP), Ponzi schemes, pyramid schemes, or fraudulent cryptocurrency investment platforms.
• Fake E-commerce: Operating fraudulent online stores or deceptive business practices designed to defraud consumers.

Email Abuse and Spam

• Unsolicited Commercial Email (UCE): The transmission of bulk, unsolicited emails (Spam) or operating mailing lists without explicit, verifiable opt-in consent.
• Mail & SMS Bombers: Hosting scripts or applications designed to overwhelm a recipient's inbox or phone with massive volumes of messages.
• Blacklisting: Any activity that results in our IP addresses being listed on global anti-spam databases (e.g., Spamhaus, SORBS).

Intellectual Property Violations

• Warez & Pirated Software: Hosting or distributing copyrighted material without authorization, including nulled scripts (e.g., nulled WHMCS/cPanel/Windows), keygens, or cracks.

High-Risk and Resource-Abusive Activities

• Tor Exit Nodes: Operating Tor exit relays, which consistently attract high volumes of network abuse complaints.
• Open Resolvers & Proxies: Running unsecured or publicly accessible Open DNS resolvers or Open Proxies that can be weaponized for amplification attacks.

Strict Enforcement & Zero-Tolerance Protocol

Violation Consequence: We maintain a strict, zero-tolerance policy against the aforementioned activities. We reserve the right to actively monitor network traffic for abuse. Should any account be found in violation of this Acceptable Use Policy, we reserve the absolute right to immediately suspend, wipe, or permanently terminate the offending server/account without prior notice. No Refund Policy: Under no circumstances will a refund be issued for services terminated due to a violation of these terms. Law enforcement will be notified where applicable.

Strictly Prohibited Activities include, but are not limited to:

• Hosting Phishing or Fraudulent websites
• Spamming or Unsolicited Bulk Emailing
• Initiating DDoS Attacks, Botnets, or Network Abuse
• Hosting or distributing Malware, Ransomware, or Viruses
• Hosting Child Exploitation Material (CSAM)
• Carding, Financial Fraud, or Identity Theft
• Severe Copyright Infringement or Piracy
• Operating Dark Web marketplaces or malicious Tor Exit Nodes

9. Unpaid Invoices & Service Suspension

9.1 Equipment Collateral: EPY Host reserves the right to assume ownership of colocated equipment if an account remains more than 30 days overdue.

9.2 Termination due to Breach: If you fail to make timely payments or violate any terms of this agreement, we may suspend or terminate services immediately. Upon termination, we reserve the right to securely wipe all data stored on the servers.

10. Upgrades and Setup Procedures

10.1 Upgrades: Requested upgrades will take effect at the start of your next billing cycle unless an immediate upgrade is fully paid for.

10.2 Setup Time: Standard setups are completed within 24 hours. Dedicated server provisioning times may vary based on hardware availability.

11. Cancellations

Cancellations must be submitted via a verified support ticket at least 24 hours before the upcoming billing due date. By requesting a cancellation, you acknowledge liability for any charges incurred up to the termination date. No pro-rated refunds will be issued for mid-cycle cancellations.

12. Service Level Agreement (SLA) & Satisfaction Guarantee

We guarantee a 99.99% network uptime. If we fail to meet this guarantee due to internal network faults, you may be eligible for service credits. Setup fees are strictly non-refundable. For any technical difficulties, clients must contact our support team for immediate resolution.

13. Limitation of Liability and Data Loss (IMPORTANT)

13.1 Data Backups: EPY Host does not automatically back up client data unless a specific managed backup service is purchased. The subscriber is solely responsible for maintaining independent, off-site backups of all data stored on our servers.

13.2 Liability: Under no circumstances shall EPY Host, its directors, or employees be held liable for any data loss, hardware failure, hardware degradation, security breaches, loss of profits, or indirect business damages resulting from the use or inability to use our services.

14. Force Majeure

EPY Host shall not be held liable for any failure or delay in performing its obligations under this TOS if such failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, wars, acts of terrorism, government restrictions, massive global internet outages, or power grid failures.

15. Amendments to the Terms of Service

EPY Host reserves the right to amend these Terms and Policies at any time. Changes will be implemented by posting the updated TOS on our website. Your continued use of our services following any updates constitutes your explicit acceptance of the revised terms. If you do not agree with the amendments, you must immediately submit a cancellation request and cease using our services.

16. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
